All prices listed in our catalog are effective from July l to June 30. Prices listed are for wholesale sales.

      ORDERS:

All orders are acknowledged upon receipt, based on availability and our projections. Spring orders received by July 31 will receive priority during the acknowledgement process. Spring orders received after July 31 will be acknowledged based on availability. Spring Final Confirmations will be mailed in early December subject to our crop yield and projection accuracy. Any customer initiated changes for spring shipments should be made by February 1.

      SHIPPING:

Our minimum shipping quantity is 25 per variety for I gallon plants, 10 per variety for 2, 3, & 5 gallon plants, and 5 per variety for 7 gallons and above. All plants are shipped F.O.B., Melfa, Virginia, and freight is due at delivery. All plants are individually tagged with UPC codes.

Freight: We ship primarily on tractor trailers and will ship partial loads and prorate the shipping costs. Customers are responsible for unloading their own plant material. TRUCK DRIVERS ARE NOT RESPONSIBLE FOR UNLOADING YOUR ORDER.

Shrubs: Our minimum delivery for shrubs is $2,500. All shrubs are shipped on shelved trucks to minimize damage in transit.

Trees: Our minimum delivery for trees is $2,500. They are shipped separately from the shrubs to lessen freight cost by maximizing the size of the load. Pooled trucks are used and partial truckloads are prorated.

Fruit trees grown at our nursery in eastern Virginia break dormancy by mid-March. In early springs, this may occur even earlier. We recommend that customers take delivery of their fruit trees as early as possible. After trees break dormancy, their roots are very susceptible to freeze injury and they should be protected after shipment when sub-freezing temperatures are expected.

New accounts are shipped C.O.D. To established accounts, the terms will be net 30 days. Past due accounts will be charged I-1/2% monthly service charge. We accept Master Card, Visa, American Express and Discover.

      DELINQUENT ACCOUNTS:

In the event suit or legal action is instituted on any past due account, we reserve the right to seek recovery for all interests, costs, and attorney fees upon trial or any appeal thereafter. We also reserve the right to require that the venue for any such suit or action shall be Accomack County, Virginia, and the substantive and procedural law of the Commonwealth of Virginia shall apply.

      CONDITIONS:

All orders are subject to crop yield, climatic conditions and other factors beyond our control. We will exercise care to have all varieties true to name. We warrant all stock to be healthy at the time of shipment. The purchaser assumes all risks after stock is delivered to the carrier. All complaints must be made to the carrier when the stock is delivered and indicated in writing on the Shipping Receipt. There is no further warranty, expressed or implied. Inany event, our liability is limited to replacing plants free or refunding purchase price.
